Acceptable Use Policy

This Acceptable Use Policy ("AUP") governs your use of the services provided by Orvia Technologies, Inc. ("Orvia", "we", "our", or "us"). This policy is incorporated by reference into our Terms of Service.

Orvia provides hotel audit and quality management software ("Services") designed for legitimate business purposes in the hospitality industry. We expect all users to use our Services responsibly and in compliance with applicable laws.


1. Intended Use

Our Services are designed for:

  • Conducting hotel, restaurant, and facility audits and inspections
  • Managing quality assurance and compliance programs
  • Documenting findings, observations, and corrective actions
  • Generating reports and analytics for operational improvement
  • Coordinating teams and managing workflows in hospitality operations
  • Training and onboarding staff on quality standards

Use of our Services outside of these intended purposes may violate this AUP.


2. Prohibited Activities

You agree NOT to use the Services to:

2.1 Illegal Activities

  • Violate any applicable local, state, national, or international law or regulation
  • Engage in or facilitate fraud, money laundering, or other financial crimes
  • Store, transmit, or distribute illegal content
  • Infringe on intellectual property rights of others
  • Violate the privacy rights of any third party

2.2 Harmful Content

  • Upload, store, or transmit content that is unlawful, defamatory, obscene, or offensive
  • Distribute malware, viruses, or other malicious code
  • Store or share content depicting exploitation, abuse, or harm
  • Create fake or misleading audit reports for fraudulent purposes
  • Upload content that could be used for harassment, stalking, or intimidation

2.3 Security Violations

  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Probe, scan, or test the vulnerability of our systems or networks
  • Circumvent or disable security features or access controls
  • Interfere with or disrupt the integrity or performance of our Services
  • Attempt to reverse engineer, decompile, or disassemble our software
  • Share login credentials or access tokens with unauthorized parties

2.4 Abuse of Service

  • Use the Services in a way that could damage, disable, overburden, or impair our servers
  • Use automated scripts or bots to access the Services without authorization
  • Resell, sublicense, or redistribute the Services without written permission
  • Use the Services for competitive analysis or to build a competing product
  • Exceed usage limits or circumvent billing mechanisms
  • Create multiple accounts to abuse trial periods or promotions — Trial eligibility is tracked by email address and payment method; attempts to circumvent this will result in immediate account termination
  • Use different email addresses or payment methods to obtain multiple trials
  • Share account credentials to exceed licensed user limits

2.5 Data Misuse

  • Collect personal data of others without proper consent
  • Store sensitive data (credit cards, SSN, health records) outside of designated secure fields
  • Export data for unauthorized purposes or in violation of privacy agreements
  • Share confidential audit data with unauthorized parties
  • Use the Services to conduct surveillance on individuals without consent

3. Content Standards

All content uploaded, stored, or transmitted through our Services must:

  • Be accurate and not intentionally misleading
  • Be owned by you or you must have the right to use it
  • Not infringe on any third party's intellectual property rights
  • Comply with all applicable laws and regulations
  • Not contain personally identifiable information of third parties without proper authorization
  • Be relevant to the intended business purpose of the Services

When conducting audits, you may capture photos or data about individuals (staff, guests, contractors). You are responsible for ensuring such data collection complies with applicable privacy laws and that affected individuals are appropriately notified.


4. Resource Usage Limits

To ensure fair access for all users, we enforce reasonable usage limits:

  • API Rate Limits: Requests are limited to prevent abuse; excessive requests may be throttled
  • Storage Limits: Each plan includes specific storage allocations; overages require plan upgrades or add-ons
  • Bandwidth: Excessive bandwidth usage may result in throttling or additional fees
  • Concurrent Users: Simultaneous logins may be limited based on your plan

5. Enforcement

We reserve the right to investigate and take appropriate action against any suspected violations of this AUP, including:

5.1 Investigation

  • Monitor usage patterns for potential violations
  • Review reported content and behavior
  • Cooperate with law enforcement when required by law

5.2 Consequences

Depending on the severity and nature of the violation, we may:

  • Warning: Issue a warning and request you to stop the prohibited activity
  • Temporary Suspension: Suspend access to the Services while investigating
  • Content Removal: Remove or disable access to violating content
  • Account Termination: Permanently terminate your account without refund
  • Legal Action: Pursue legal remedies for serious violations

For severe violations (illegal activity, security breaches, intentional harm), we may immediately terminate your account without prior notice. No refunds will be provided for accounts terminated due to AUP violations.


6. Reporting Violations

If you become aware of any violation of this AUP, please report it immediately:

  • Email: abuse@orviahq.com
  • Include: Description of the violation, relevant evidence, and any affected parties

We take all reports seriously and will investigate promptly. You may report anonymously, but providing contact information helps us follow up if needed.


7. Your Responsibilities

As an account holder, you are responsible for:

  • Ensuring all users under your account comply with this AUP
  • Promptly notifying us if you become aware of violations by your users
  • Maintaining adequate security for your account credentials
  • Training your team on acceptable use guidelines
  • Responding to our inquiries about potential violations

8. Changes to This Policy

We may update this AUP from time to time. We will notify you of material changes by:

  • Posting the updated policy on our website
  • Updating the "Last Updated" date at the top of this page
  • Sending email notification for significant changes

Continued use of our Services after changes constitutes acceptance of the updated AUP.
